EatStreet, Inc. Marketplace Order Form

This Marketplace Order Form (“Order Form”) is made effective as of the date of signature (“Effective Date”), by and between EatStreet, Inc., a Delaware corporation with offices located at 811 East Washington Avenue, Suite 400, Madison, WI 53703 (“EatStreet”), and Merchant (identified in the following table). EatStreet and Merchant may be referred to herein individually as a “Party” and collectively, the “Parties”.

1. Terms of Order Form | This Order Form is governed by EatStreet’s Merchant Terms and Conditions found at: https://eatstreet.com/restaurant-terms-of-service, as may be updated or modified from time to time by EatStreet (the “Terms and Conditions”), which are hereby incorporated by reference and made a part hereof. In the event of any conflict between the provisions of this Order Form and the Terms and Conditions, the provisions of this Order Form shall govern and control solely with respect to the subject matter hereof. Unless otherwise expressly defined herein, all capitalized but not otherwise defined terms used in this Order Form shall have the meaning stated in the Terms and Conditions.
2. Order Form | This Order Form as issued by EatStreet is an offer by EatStreet exclusive to Merchant. When executed by both EatStreet and Merchant, this Order Form becomes a binding agreement for the provision of Marketplace Services, Delivery Services, and Marketing and Promotional Services in accordance with the Terms and Conditions.
3. Services and Fees | Merchant requests EatStreet to provide the services below as indicated.
